Nu de puţin ori auzim români care pleacă în străinătate în căutarea unui loc de muncă mai bun şi obţinerea unui trai decent! Unii reuşesc cu mult efort să se realizeze peste hotare, alţii se întorc dezamăgiţi, iar majoritatea cad pradă invidiilor, sunt discriminaţi şi, de multe ori, hărţuiţi.
Unul dintre aceşti oameni, care a trecut prin asemenea momente şi care a decis să ne ceară ajutorul, este Doru B. Bărbatul a căzut victimă unei campanii de denigrare şi hărţuire, în urma căreia şi-a pierdut locul de muncă pe motiv că este… imigrant. Vă redăm integral scrisoarea ne-a trimis-o la redacţie, citiţi, şi-o să descoperiţi ce-a păţit un român în America:
„Mă numesc Doru B. şi locuiesc în România din ianuarie 2009. Am plecat din România împreună cu familia (tata şi mama), ca refugiaţi politic în 1987 în USA.
Începând din 4 ianuarie, 2000 am lucrat în contabilitate la Sacramento Superior Court.
Din 2001 au început necazurile. În martie 2001, două colege de serviciu a început să mă atace mereu după ce am început să aplic pentru poziţii mai bune. Mai mult, au început să răspândească zvonuri că aş fi anti american invocând motive ca: îmi place berea germană, că am ales să conduc o Mazda, că am zburat în România cu KLM, că am folosit companii americane.
După atacul din noiembrie 2001, supervisera mea (o negresă) a început să mă întrebe ce religie am, ce apartenenţă politică şi alte întrebări personale, culminând cu întrebarea: cât e de departe România de Afganistan. Managera mea W.W. habar nu avea de România nici de Afganistan, considerându-mă că aş fi de undeva din Orientul Mijlociu. Am fost ofensat, practic m-a considerat ca pe un potenţial terorist. Până şi sindicatul UPE1 a afirmat că este o ofensă: de ce nu i-a pus asemenea întrebări lui Steve sau Kirk, şi de ce ţie, că eşti imigrant?
După acest incident, supervisara mea W.W. a început o campanie puternică de denigrare a mea şi de hărţuire. În aprilie 2004, cu ajutorul unei alte persoane de culoare din Human Resources, invocând neadevăruri şi exagerări de fapte, au reuşit să mă suspende pentru trei zile. După ce reprezentatul sindicatului UPE1 de atunci a protestat la îndemnurile mele, tribunalul s-a oferit să-mi dea înapoi două zile, pe care eu le-am refuzat. Am spus că am fost suspendat abuziv de supervisora mea şi trebuie să mi se dea înapoi toate cele trei zile. Tribunalul a refuzat să-mi dea toate cele trei zile înapoi.
După numai câteva luni, acelaşi cuplu de negri au încercat să mă suspende pentru 10 zile, continuând şirul de minciuni inventând fapte. Dar am putut arăta motivele invocate să mă dea afară sunt doar minciuni şi pretexte să mă dea afară. Unul din motivele suspendării de 10 zile a fost că… m-am plâns sindicatului de abuzurile managerei (asta a fost culmea prostiei pentru că suspendarea a fost anulată şi acea persoana de culoare M.F. a dispărut din angajaţii tribunalului).
Imediat acestui incident, şefa tribunalului de atunci, a trimis un ordin în care se arată clar ca tribunalul trebuie să aplice disciplină progresivă, adică să suspende pe 3 zile, 10 zile şi eventual (dacă nu mai există nicio altă cale) să concedieze. În cazul meu, nu s-a întâmplat aşa cum cerea CEO de la Sacramento Superior Court, J.P. (o femeie din India). Între timp, J.P. a devenit CEO la AOC (Administrative Office of the Court), institutie care dadea toate ordinele şi impunea regulamentul tribunalelor din California. J.P. în timpul când a fost CEO la tribunal, a devenit prietena foarte bună cu managera mea W.W.
În data de 4 ianuarie 2007 am fost dat afară în timp ce eram în concediu medical pe baza de stres şi depresie datorită discriminării şi hărţuirii constante a managerei W.W. Aceasta constituind un mare abuz, total contrar legilor. Acest abuz a fost urmat de un alt mare abuz: nu s-a respectat procedura dată de CEO, J.P. de a se aplica disciplina progresivă. Eu practic am fost suspendat doar trei zile (şi în acel caz au vrut să-mi dea două zile înapoi), nu am mai avut nici o alte suspendare. Deci au fost abuzuri grave comise de Sacramento Superior Court împotriva mea doar să protejeze o persoană de culoare, prietena bună cu CEO de la AOC.
Ca să vorbesc de incompetenţa managerei W.W., în 2006 am adus la cunoştinţa şefului contabil pe tribunal CFO, R.B. ca tribunalul a pierdut venituri de peste jumătate de milion de dolari datorită managerei W.W. La acel timp, R.B. mi-a mulţumit, fiind de acord cu cele constatate de mine.
După ce am fost concediat sindicatul a început acţiunea pentru a merge la arbitrajul de munca. Între timp, sindicatul mi-a propus o sumă ridicolă ca să nu se mai ajunge la arbitraj, dar nici să nu mă mai întorc la servici. Reprezentantul sindicatului T.S. mi-a cerut şi $5,000 şpaga, ca să-mi acorde suma care mi-a propus-o.
Nu mai vorbesc ca la puţin timp după ce sindicatul a decis să meargă la arbitraj, la un moment dat m-a anunţat că nu mai vor să mă reprezinte. După ce am mers la un avocat, avocatul mi-a spus că îl cunoaşte pe managerul general de la sindicat şi că mă vor reprezenta din nou, ceea ce s-a şi întâmplat.
Există şi emailuri în care chiar sindicatul (chiar managerul general) recunoaşte erori grave ale tribunalului, dar… nu au fost prezentate la tribunal. Vânzare clară.
De când am refuzat propunerea reprezentantului T.S., sindicatul a fost 100% împotriva mea. A început să mă hărţuie, să sortez documentele ba în ordine alfabetică, ba după dată, etc., a amânat data arbitrajului de câteva ori sub nişte pretexte ridicole.
Sindicatul mi-a trimis un alt reprezentant să mă reprezinte la arbitraj. Acest nou reprezentant al sindicatului a refuzat să aducă martorii pe care i-am cerut, a refuzat să prezinte documente foarte importante în favoarea mea, a refuzat să prezint eu versiunea mea a evenimentelor în faţa arbitrorului, a refuzat să prezint eu un raport cu toate evenimentele importante avute cu cele două colege, supervisora (între timp devenită manager) W.W.
Practic, sindicatul m-a vandut la arbitraj. Eu nu am avut niciun cuvânt, niciun drept, nimic. Procesul a fost un parodie în care eu practic eram condamnat dinainte de a fi fost început. Se ştia deja deznodământul. Exact un proces stalinist, bine că nu era vorba de condamnare la moarte.
Am dovezi clare şi pot dovedi cu documente toate faptele.
După rezultatul acordat de excrocul de arbitror cumpărat/influenţat de sindicat şi de tribunal, am intrat în greva foamei timp de 30 de zile. În tot acest timp, cu toate ca anunţasem ziarele, posturile de televiziune, autoritatile şi politicienii din California şi tot cuprinsul US, inclusiv Preşedintele US, Departamentul de Justiţie, FBI, nu m-a băgat nimeni în seamă.
Când am încercat ultima dată să promovez pe poziţia de superviser (în 2005), managera mea W.W. a angajat o negresă F.B. care nu avea experienţa mea în contabilitate, nu avea experienţă guvernamentală. Am aflat că acea negresă (după un an de servici), a fost dată afară că ar fi minţit în cererea iniţială cu privire la calificarea ei. La un moment dat, acea supervisora F.B. încercă să mă convingă ca albii sunt rasişti şi negri doar… oportunişti. Această afirmaţie este clar rasistă. Când eu am replicat că există rasişti de ambele părţi, a început să ţipe la mine. În altă zi, vorbind despre Affirmative Action, am afirmat că este o lege care divizează ţara, promovează incompetenţa, este rasistă şi se încalcă Constituţia americană.
Din nou a început să ridice tonul, afirmând că şi negri au fost discriminaţi – deci acum ar fi normal să discrimineze şi ei pe albi.
Cu doar două săptămâni înainte de a mă da afară, aceeaşi managera W.W. a angajat un negru (pe care eu a trebuit să-l trăinuiesc), care nu avea nicio experienţă în contabilitate şi nici educaţie în contabilitate. Rasism clar.
Tribunalul nu avea curajul să mă dea afară daca nu ştia exact ca sindicatul nu e de partea lor – pentru că nu au avut motive intemeiate. Având colaborarea deplină a sindicatului şi a arbitrorului J.K. ales de sindicat, cu toată dreptatea de partea mea, nu am avut nicio şansă.
Procesul de arbitraj a durat aproape doi ani (când prin lege trebuie să se termine într-un an – expedite arbitration).
În concluzie, cu un caz beton (chiar doi avocaţi au spus că nu văd cum aş putea pierde cazul), am pierdut.
A fost o corupţie şi conspiraţie în trei: sindicat, tribunal şi arbitror.
Mulţumesc democraţiei americane, mai bine zis, ipocriziei americane, care vor să fie un exemplu de democraţie pe tot globul, dar la ei acasă se întâmplă orori judiciale, corupţii şi conspiraţii imense, de invidiat chiar şi de cele mai totalitare şi dictatoriale ţări.
Datorită acestei manevre, în care am fost discriminat rasial şi pe bază de origine naţională (aşa cum un reprezentant al sindicatului R.B. a numit un protest împotriva tribunalului), hărţuit şi umilit, dat afară fără motive intemeiate nu am obţinut niciun fel de compensaţie – care ar fi trebuit să fie de sute de mii de dolari. Acest caz, dacă se întâmpla unei persoane de culoare (la o companie privată) ar fi primit mai mult ca sigur milione de dolari şi N pagini de ziar.
După ce am fost concediat, am fost în concediu medical pe o perioadă de 7 luni datorită stresului şi depresiei. Nu am mai găsit de lucru în contabilitate, ci sporadic câteva luni. Am rămas fără locuinţă, rămânând de dormeam în maşină, îmbolnăvindu-mă şi mai tare.
În fine, cu ajutorul donaţiei unei biserici din Sacramento, am reuşit să vin în România unde locuiesc de atunci.
A contactat Ambasada americană, prima dată am fost ignorat, fără a primi un răspuns concret. Între timp, am trimis zeci de emailuri şi scrisori la autorităţile americane să întreprindă o investigaţie în acest cras caz de discriminare, corupţie şi conspiraţie, nimeni nu s-a sinchisit. Nici măcar autorităţile române la care am cerut ajutorul pentru a interveni în sprijinul unui român discriminat şi împotriva căruia s-au comis mari ilegalităţi de către agenţii guvernamentale americane, sindicat şi arbitror.
Am mai avut un caz de workers compensation împotriva tribunalului pe baza de stres şi depresie cauzate la locul de muncă. Găsisem şi un avocat sa preia cazul D.M. De când am venit în România, avocatul nu a mai răspuns la nicio scrisoare.
Mai am şi acum un caz de discriminare împotriva tribunalului, la care depusesem un amendament (de fapt, amendamentul era cel mai important), şi am fost informat că amendamentul a fost scos de către avocatul tribunalului ca amendamentul a fost scos pe motive că… nu ar fi important şi în legătura cu cazul.
Practic, eu am fost pedepsit de managerii de la Sacramento Superior Court că am demascat rasismul, nepotismul (la angajări şi promovări, am cazuri concrete) şi favoritismul. Mai mult, am demascat ca sindicatul UPE1 nu este decât o sluga care execută ordinele angajatorului şi nicidecum nu reprezintă interesele angajaţilor aşa cum ar trebui. Relaţia angajator-sindicat între aceste două instituţii este doar să dea impresia de democraţie, de legalitate, când în realitate, este o conspiraţie şi o unitate între sindicat şi tribunalul din Sacramento.
Aceste două institutii s-au coalizat să mă pedepsească crunt pentru îndrăzneala mea de a le da în vileag ilegalităţile crase, eu un simplu angajat în contabilitate, eu un imigrant, un nimeni.”
În continuare, vă redăm un document trimis de dl. Doru B. către Ambasada Americană la Bucureşti. I-au cerut dovezi şi le-am trimis 62 de email-uri cu documente.
Au promis că îl vor ajuta să găsească o firmă de avocaţi, dar ce au găsit ei, nu se poate comunica cu ei. În plus, acea organizaţie (pro bono), când a fost în Sacramento care deja îi contactase, i-a promis că nu-l pot ajuta.
În plus, Ambasada americană i-au mai promis că îi vor acorda şi asistenţă socială în România, dar se pare că au uitat. Nu a primit niciun fel de asistenţă şi nici un contact concret cu o firmă de avocaţi. Totul a rămas doar la promisiuni.
Din punctul de vedere al persoanei în cauză, ceea ce a făcut sindicatul UPE1 este ilegal. A refuzat să transmită dorinţa sa de înţelegere cu tribunalul.
Publicăm în facsimil şi alte documente în care reiese clar că NU dl. Doru ESTE PROBLEMA ÎN CONTABILITATE.
Scriind la Ambasada Americana si fiind un email mai dur, de atunci, îl caută poliţia. A dat o declaraţie acum două săptămâni la Târgu Neamţ unde au venit trei de la poliţie. Săptămâna trecută, marţi, a fost chemat la poliţie în Piatra Neamt unde am mai dat o declaraţie.
Sâmbătă a fost o înscenare când a venit din nou poliţia din Târgu Neamţ afirmând că domnia sa, Doru B. a sunat la 112 că s-a întâmplat o nenorocire. Doi bătrâni au fost şocaţi de hărţuielile poliţiei, el nefiind acasă. O adevărată nebunie.

RESPONSE TO SACRAMENTO SUPERIOR COURT – EMPLOYMENT – WRONGFUL TERMINATION CASE, DISCRIMINATION AND RETALIATION
I was terminated on February 9, 2007, after seven years of employment with Sacramento Superior Court. I am convinced I was fired due to race, gender and national origin discrimination and retaliation. The last day of effective work was January 5, 2007.
I was hired on January 04, 2000. I worked for Sacramento Superior Court as an Account Clerk II, for five years at CMJC (Carol Miller Justice Courthouse) and the last two years and one month at FRC (Family Relation Courthouse).
When I was hired I had an AA degree in Accounting from American River College, then in October 2005 I got a BS degree in Accounting.
With just two-three weeks before I was terminated, Wanda Williams (an African-American woman, my manager), hired a black male with no accounting experience and no education in accounting to replace me (I had to train him).
In December of 2005, the court posted a position of supervisor at FRC another one in downtown. I applied for both positions. Downtown was hired a technician, a woman named Verlaine McCasling and at FRC a woman from outside the court. In the day she had to come to work, announced the court that she’ll not be working for the court, and the position was open again.
In April of 2006, Wanda Williams hired an African-American woman as supervisor. I applied for the position also, but despite my education and six years experience with the court, Wanda Williams preferred to hire and African-American woman (Francine Burrell) from outside the court with no experience in Government Accounting.
Despite my education and experience, I could not get any better position within the court, or with AOC.
The accusations from the Termination Report are false, fabricated and deceiving, brought only just to make-up a case against me, to fire me, because I revealed the Court corruption, nepotism, favoritism, harassment and discrimination.
At the Sacramento Superior Court I was treated as a second class citizen or even worse (probably they believed that I might be from Middle East or maybe a terrorist since after 9/11 2001, Wanda Williams, my supervisor, questioned me about my political views, my religion and she asked me: “how far is Romania from Afghanistan?”
I was intentionally ignored by most of my colleagues and not invited to participate at lottery games and pizza (as later I was told by Kirk Lacefield, a colleague); the co-workers who ignored me or had a hostile reactions against me were Wanda Williams and her clique. Now, all employees who were part of Wanda’s clique (Monica Hodge, Amy Calloway, and Lynn Dunbar got jobs with AOC, or better jobs within the court. It’s just a coincidence, or a reward? I have no doubt it was a reward.
I was accused of insubordination by Francine Burrell and Wanda Williams. I want to make it very clear: I was not and never even intended to be insubordinate, period!
My doctor Stephen Mandaro from US Davis recommended in September 9, 2003 (and later with different occasions) the Sacramento Superior Court in a letter to Marcus Freeman (from HR), to be moved away from Wanda Williams and her clique. It never happened and the result – I was fired.
At any meeting I had with Rick Beard (the CFO of he court), he told me to find a job somewhere else. Also Tina Slaughter, the HR manager. At the meeting I had on August 28, 2006, Tina Slaughter even told me to apply at the court in Placer County. They never told me why I had to find a job anywhere else, when I asked.
Now and more than ever, I realized that I was right; they wanted to get rid of me, and they did. I had this feeling since 2001 (see the documents), and from 2003 it was obvious! Wanda Williams made a case of constructive termination, to fire me.
On January 03, 20007, after receiving and e-mail from my manager Wanda Williams accusing me that I did not follow the Court rules (I’ll explain later in detail), I had a shock, I felt that all my power dropped and I had problems breathing, I had a breakdown. I asked my supervisor to go home and I went to the doctor Elliot Eisenbud. He consulted me and gave me Lexapro for stress and anxiety. I knew that Wanda Williams and Francine Burrell were planning to fire me; otherwise, they would not have brought false accusations against me. It was clear; Wanda made another conspiracy to fire me, this time with Francine Burrell.
On January 04, 2007, I was still sick and I couldn’t go to work, but I went to work on Friday, January 5, despite the fact that I still didn’t feel well at all.
For the next two weeks, from 01/08/07 until 01/19/07, I had a medical note from UC Davis, excusing me from work due to stress in the workplace.
What is very interesting – on 01/10/07 Ted Somera the UPE1 business agent, sent an email to Human Resources and cc me, to provide me with workman’s compensation and discrimination papers.
Two days later, on 01/12/07, I received “Proposed Termination” papers from the Court, while I was sick, on medical leave. The time of termination shows clear retaliation for asking for worker’s compensation and discrimination papers, and a perfect time for pushing me out of the door. That shows very low ethics and morale of part of Court managers. That shows that they are capable of anything, just as in a totalitarian state, where they totally ignore the law, the ethics and definitely not about their employees.
Below I’ll present the facts why I believe I was fired:
• Racial discrimination – the manager Wanda Williams is a black woman and she caused me problems almost since I was hired (she was supervisor then). She also caused many problems to Kirk Lacefiled, another Caucasian male. In April of 2006, Wanda Williams hired Francine Burrell as a supervisor (also a black woman), despite the fact that Francine Burrell didn’t have experience in Government Accounting and of course, with the Court. I applied for the same position and I consider that I was better qualified since I had six years experience with the Court and a BS degree in Accounting. For the same position, Accounting Supervisor, in Downtown, the Court hired an Accounting Technician (Verlaine McCaslin) with experience with the Court but without a degree. With only two weeks before I was fired, Wanda Williams hired an Account Clerk to replace me, a black man named Rork Crusto, with no degree in accounting and no experience in accounting. I had to train him to do my job and due to his lack of knowledge and experience he had many problems understanding the job. This is very clear racial discrimination and the abuse in power by my manager, Wanda Williams.
From the beginning, Wanda Williams had two strong allies in Johnny Smith and Marcus Freeman, both of them working in HR, and both of them helped Wanda Williams to make a case against me. Both of them are African-Americans as well as Wanda Williams. It’s what I strongly believe a case of racial discrimination.
• Racial discrimination – On 11/16/06 it was a discussion with Francine Burrell, Gary Bradley, the new supervisor hired in Probate, and I. At that discussion, Francine Burrell made racist comments about white people and I felt insulted. Francine stated that the white people are racists and the black people are not racists, but opportunists. Also, regarding affirmative action she stated that we should have affirmative action. I stated that is against the Constitution and is divisive. After that discussion, Francine Burrell changed totally her attitude and behavior towards me to worse. She started to blame me for anything and to accuse me of insubordination.
• Gender discrimination – I think that more than 70% of the Court employees are women, and the percentage is even bigger for supervisors and managers. At CMJC and FRC the percentage is even bigger, probably over 80-90% and in some cases up to 100%. When I worked at FRC (2004-2007), ALL the managers on the second floor were women. At CMJC (2000-2004), same thing, all managers were women: in UD and SC, supervisors were women and the manager was a woman, then, all of them have been replaced with….other women. In accounting the same, it was a woman supervisor and replaced with another woman (Wanda Williams). The Building manager also was a woman replaced with another woman (Meredith Bostian). These are facts and easily could be verified.
I applied for Budget Analyst, for Accounting Supervisor three times, for Accounting Technician; every position was filled by a woman. At FRC, twice Wanda Williams brought women from outside the Court for the position of Accounting Supervisor, one didn’t want the job and the other one was Francine Burrell, which was fired. In downtown, was hired Verlaine McCastling, with no degree in accounting but many years of experience. Later it was proved that Verlaine didn’t know to reconcile a spreadsheet.
• Gender/race discrimination – I was the only male at FRC (last two years), and in the last year, the only Caucasian, which I was replaced by an incompetent black male. At FRC, as far as I know, never worked a male until I was transferred.
• National origin discrimination – After September 11 2001, Wanda Williams took me aside and had a discussion with her. Wanda asked me about my political views, my religion and why I left Romania? Then she asked me: “how far is Romania from Afghanistan?” I was ashamed and worry because she thought that I might be from a country from Middle East, and I didn’t want to be associated in any way and with anybody from that region. I was outraged and horrified of what happened on 9/11/01 and didn’t want anybody to believe that I am in any way from that region. And why did she ask me about my political views and my religion? Why my political views and my religion were so important for her to know? By the way Wanda treated me, only an enemy would be threaten. I consider that it was mental torture what happened to me in all these seven years at the court under constant harassment, humiliation, stress and fear. These facts have been also raised to the Human Resources and to AOC at that time (Mrs. Murphy and Mrs. Whitehead investigated).
• National origin discrimination – In March 2001 I had a discussion with Doloris Gillam about medical insurance in general. I stated that “it would be a good idea that everybody will have some medical insurance (it was based on my past experience here in US). When Doloris heard that, she exploded in anger, she yelled at me saying: “you should go back where you came from, we don’t want communism here”.
• National origin discrimination – Also in 2001, Doloris Gillam spread rumors about me that I was anti-American. In her mind, I was anti-American because I liked to drink German beer, flew to Europe with KLM instead of Delta or AA, because I bought a Mazda, “another foreign car”…etc…
• Retaliation – UPE1 and I filed two grievances against Wanda Williams, few co-workers, part of Wanda’s clique; first one was in April 11, 2003 and the second grievance was in 06/11/2006. I also filed three complaints against the Court and Wanda Williams with DFEH. (05/14/03; 07/14/06 and 03/28/07). I filed another worker’s compensation case in January 3, 2007.
• Retaliation because on August 19, 2004, I brought to the attention of the Division manager Bostian Meredith the fact that Wanda Williams and her clique (Amy Calloway, Lynn Dunbar and Monica Hodge) of friends went to lunch for on hour and a half. Before they went to lunch, Kirk Lacefiled went to lunch also, leaving in accounting only two employees. It was against Wanda’s orders, “no more than two employees should go to lunch”. Meredith Bostian thanked me for bringing the issue to her attention. It was usual for Wanda and her clique to go to lunch for up to two hours up to three times a week.
• Retaliation because I complaint to AOC in 2003 and to DFEH about Wanda’s abuses regarding questioning me about my personal political and religious views and for her assumption that I was a Muslim.
• Retaliation/Whistle blower because I wrote an email in February 17, 2006 to Rick Beard, the Court CFO that the court lost more than half a million of dollars due to Wanda’s bad management and/or negligence/incompetence (see the documents). I was told that in a private company she would have been fired on the spot. At the Sac. Sup. Court, these things are hidden, that incompetent manager is kept in function and the person who reported the mismanagement is fired.
• Retaliation because also in February 12, 2006, Steve Spinelli didn’t follow the court procedures and didn’t seal the plastic envelopes for Loomis and the court lost about $386 in cash. It was again Wanda’s fault, because Steve worked at CMJC, under her supervision. Wanda lied to Rick Beard about the incident, because when Rick Beard heard the sequence of the events, he was amazed, and stated: “I have to go to CMJC to see what is going on there”!
• Retaliation because I brought to the attention of the big management (Rick Beard, Tina Slaughter and Dennis Jones) that hiring and promoting is done based on race, nepotism and favoritism (see the documents).
I was in medical disability since February 9, 2007 until September 15, 2007 due to stress and anxiety caused again by Wanda Williams and this time, with the help of Francine Burrell, the new supervisor. It is the third time I went in disability due to Wanda Williams and her clique.
I’ll try to respond to all the accusations brought against me by the manager Wanda Williams and the Sacramento Superior Court..
On February 2, 2004, I was suspended for three days. In that three days suspension there were false accusations, testimonies and twisted truth, in retaliation because I made complaints against Wanda Williams and few co-workers very good friends of Wanda Williams. It was in retaliation because in April 11, 2003 I filed a grievance against Wanda Williams and the Court. Also in April I filed for worker’s compensation and I went in disability, and I returned from disability on September 07, 2003. In September 22, 2003 I went to doctor in Dixon for “Fitness-For-Duty Evaluation”. Later in October 20, 2003, I was put under Wanda Williams’ for a “Performance Improvement Plan” for four weeks, and I was told that in the last week I failed. I had no chances; Wanda wrote whatever she wanted in the weekly reports, despite my protests.
On April 9, 2004, Wanda Williams and Marcus Freeman wanted to suspend me for ten days, and then to fire me; but because in their desire to bring all kind of charges against me, one of the charge was that I have complaint to the union. I had all my rights to complain to the union, what is the union for? The union is not to defend the employees against the employer’s abuses? At the Skelly meeting, they had to rescind the ten days suspension.
The Court sent me first to Dr. Kimmel and after giving me an acceptable evaluation, the Court didn’t like it, then I was sent to Dr. Kaufmann, which he changed the whole evaluation. How is this possible? The Court wanted me fired with any price.
Also in 2004 Wanda Williams and Marcus Freeman sent me for evaluation at a psychologist, Dr. Kaufmann, at 2801 K St. in Sacramento. Dr. Kaufmann told me that few women coworkers made complaints about me and that was the reason for evaluation.
I was the one who made complaints first through the union against those women and none of them were sent to psychological evaluation.
Monica started all the troubles at CMJC (see Amy’s email) and profited she was doing a lot of work for Wanda Williams, and Wanda was protecting her as being “the right hand” by Wanda’s own words.
In 2006 I wrote to the CEO few emails to show him how the supervisor, Francine Burrell and the manager Wanda Williams were treating me and I showed my frustration that nobody did anything to stop the continuous harassment and discrimination against me. The reason I continued writing those emails was because Mr. Dennis Jones never replied to me, I didn’t get any answer from him. In the past when I wrote to Jody Patel and to Curt Soderlund, I received answers from them.
Even Arlene Benson described on March 17, 2007 very well the situation of FRC (Family Relation Courthouse), it was a very bad working environment. Arlene Benson was pushed out, to retire, despite the fact she wanted to work longer and I was fired.
The last Caucasians (Arlene and I) at FRC were pushed out of the door on different pretexts. That’s clear racial discrimination!
At CMJC, Kirk Lacefiled stated clear that it was a bad working environment due to Wanda Williams and her clique. Even Amy Calloway admitted the bad working environment at CMJC and the awful behavior of Monica Hodge who started conflicts with Kirk and me then with Amy. And how come Steve Spinelli didn’t hear anything, because he was ashamed to lie.
At FRC, Arlene Benson had same opinion of bad working environment with Wanda Williams, Malay Thongtip and the new supervisor Francine Burrell.
Wanda Williams denied me the right to have a job at the court, harassed and humiliated me, denied me to any advancement, discriminated me, denied me the right to enjoy the life. Wanda Williams and her clique messed up my life, my future, my health, and affected also my family.
Physically – I last year I was diagnosed with diabetes, a very serious disease which affect many vital organs and the eye sight, and other important things. It is a disease due to stress. I was very stressed at the Court; I was three times in disability due to stress and anxiety due to Wanda Williams and her working environment (see the documents).
Other symptoms: insomnia, nightmares, very tired, the blood pressure oscillating, irregular heat beat, gained weight, head aches, lack of exercise, etc.
Stress led to immune system disorders.
Psychically – The experience with Wanda Williams, Francine Burrell and the clique changed me very much. I don’t trust people anymore, I feel like everybody is against me, is hostile to me. I used to be an optimist, to believe in the future, to enjoy life; I was smiling, laughing. Now, everything is changed, seems like I am a different person. I don’t know, probably I’ll never recover. It was like a mental torture well organized by Wanda Williams and Human Resources and Rick Beard and others who didn’t want to apply what Dr. Stephan Mandaro very clear stated: to be moved away from Wanda Williams and her environment.
I was in stress since 2001 due to Wanda Williams and her clique and gradually my frustration, the stress and anxiety grew progressively.
Want as witnesses:
Rick Beard, CFO. I want him on the witness stand to tell me if he liked the way I was treated by Wanda Williams and her clique. I met with him for about 5-6 times I told him many things and gave him many examples of what happened to me and what is the situation at CMJC and FRC. I want to tell me why he told me at every meeting I had with him to find job somewhere else, despite the fact that I told him that I want to work for the court or AOC.
I want to ask Rick Beard frankly – why did he tell me that “from all the cases which will go to arbitration, only 2% are won by employees?” I consider this statement – intimidation towards me and it also shows that arbitrators are corrupt and biased towards the employer. Also, it shows arrogance and total disrespect for the employees.
I want to ask Rick Beard why he didn’t dare to come to me, as he promised, to analyze the spreadsheet when I had a big dispute with Verlaine McCaslin. Was he afraid that I was right? Of course he saw the spreadsheet and he knew right a way that I was right. He supposed to have the dignity to come to say the truth. Yes, after that incident, I accused them of hiring based on nepotism. I applied for the position of Verlaine, and Verlaine got the job, and she didn’t know how to reconcile a spreadsheet.
How could Rick Beard accept the hiring of Francine Burrell for Accounting Supervisor when Francine had no experience in Government Accounting?
When I asked Rick how was possible for not getting any promotions despite me education and experience, his answer was: “you had bad luck!”
How could Rick Beard accept the hiring of Rork Crusto, when Rork has no accounting experience at all and no degree in accounting?
Both persons hired were interviewed by Wanda Williams, Accounting Manager at CMJC and FRC; both hiring were based on race, and definitely not the best candidate has been elected, as the Court rules.
Dennis Jones, CEO. I want to ask him why he didn’t want to respond at my e-mails. Why he didn’t want to meet with me? As a CEO with an “open door” policy he supposed to meet with me and to discuss the issues. It never happened. In this case, seems like only manager’s opinion maters, the rest of the employees are not important.
I wanted to ask him why he didn’t respond to my email when I asked to be paid by the court $60,000? As I explained in the email, that amount it was it supposed to be from the workers compensation case against the court. It what Nick Sheedy, my ex-lawyer told me the case was worth it. Mr. Dennis Jones knows very well what happened behind the scenes with Marcus Freeman, Jeff Young and Nick Sheedy.
Tina Slaughter, Manager in HR. I want to tell how she told me in two different occasions to find job somewhere else, and in August 28, 2006 she told me to look for work at the court at Placer County, and why? Tina and Rick never explained why I supposed to look for work somewhere else, despite the fact I told them that I want to work for the court in Sacramento.
How Malay encouraged me to apply for Accounting Supervisor? Malay told me: “why do you want to apply for supervisor, to argue with Arlene everyday?” Is this encouragement? Why Tina Slaughter was lying and could be so bias against me?
Malay Thongtip, coworker at FRC. I want to ask her who is/are her “high connections”, as she stated in 2006 (see the emails).
I want to ask her honestly (she told me that she never lies, she claims as very religious) why she proposed me to be supervisor? Seem to me that she knew exactly the whole scenario. She told me to be supervisor because it will be a opening position in Auditing and Francine has experience in auditing will get that job and her position will be open again and I could get the Accounting Supervisor job.
I want to tell me that she didn’t invite me to Marysville at her church Jehovah’s Witnesses. I want to tell me that she didn’t bring the tapes for me to take them home to watch them, to tell me that I lay. I want to see if she dares to tell me that I am a liar, I want to see her face saying that.
I want to tell me if she didn’t sell cosmetic products to Wanda Williams and to Francine Burrell, and to many other employees. She has a part-time business selling cosmetic products, and saying that she got approval from Johnny Smith.
I want to ask her: why did she use that tactic of sexual harassment against me? What was her scope? Even Johnny Smith (HR) admitted that has been “sexual misconduct”.
I want to ask her, why did she insult me few times that I was stinky; because I didn’t buy her cosmetic products?
I want to ask her if she didn’t preach on the phone her students and it happened many times.
I want to ask her if she didn’t call me directly into my face: “liar”.
Malay insulted me so many times and she was never punished, anyway, not for what she did to me.
Catherine Medina, CMJC. – When I had an incident with Amy Calloway, when Amy accused me of harassing her when I was closing with her on 2004, Medina witnessed the whole story, and she stated that I was the one aggressed by Amy Calloway. She made a clear statement at that time.
Also, in a different day in 2004, she came with me at Wanda Williams to allow me to go to the doctor because Wanda Williams found all kind of reasons not to allow me to go to the doctor. After Catherine Medina came with me at Wanda, she agreed to permit me to go to the doctor.
Why did she send me an email with a position in accounting with the State? Who directed her to send me that position, when Rick Beard and Tina Slaughter, both were pushing me to get a job out of the court?
Roberta Battle, she was my business agent from the beginning. She knows many things about Court abuses. She stated that “the Court is one of the worst places she ever seen.” She saw many abuses.
Jeff Young, he was my business agent with UPE1 and he knows many things, many issues regarding my case, he could be a very good witness.
Kirk Lacefiled, coworker at CMJC. He was harassed by Wanda Williams many times and by Monica Hodge and by Lynn Dunbar and by Doloris Gillam. I understood that he was even suspended and was a period in disability due to Wanda and her clique. He is another Caucasian male harassed by Wanda Williams.
I want to tell in front of the arbitrator what was the reason he was/is afraid to talk to me, period, to explain exactly what he told me when I met him, his wife and their kid in front at FRC. He told me that he could not talk to me, exactly “you know, Wanda….” That means Wanda told him specifically not to communicate with me. How is possible Wanda to put pressing on whom to talk or not? I want him to tell his opinion regarding the working environment at CMJC, when he stated very clear in a e-mail “all the women here are crazy”! I totally agree with him, it was a crazy environment created by Wanda Williams and her clique.
I want him to tell how Doloris and Amy could close together and Kirk and I could not, even Meredith was called to watch us, when Kirk called me for few minutes when he needed help.
Francine Burrell, supervisor FRC. I want to ask her how could she accused me of insubordination when I helped her in numerous situation, when she asked me and not only. Who told her to act in that way?
I want to ask her about the discussion we had about affirmative action and about that discussion when she was in Chicago and the white people didn’t want the blacks to move close to them and when she stated that the blacks are opportunist.
I want to tell me if she received the email I sent her about voids and reversals, and why she told Rick she didn’t receive the email?
I want to state that we had interesting discussion at the beginning; she has a lot of knowledge about everything, history, geography, politics, actors, movies, etc…
Arlene Benson, coworker at FRC. She had problems with Wanda Williams, and she stated that she explained to Wanda something in accounting and Wanda had a hard time understanding.
Arlene Benson had also many problems with Malay Thongtip and Malay insulted Arlen, calling her “cow”, and Malay always had only bad opinion about Arlene, nothing good (except when Arlene had to buy cosmetics).
Arlene stated that Wanda pushed her to retire. Arlene was also not part of the clique, she was working for the court for too long time and she knew many things.
Arlene saw and heard part of Malay sexual harassment directed to me, and her religious teaching on the phone.
Verlaine McCaslin, supervisor downtown. I want to ask her if she remember when I discussed to Bridgette Hubs and her about Wanda’s big error (in January of 2004) in UD adjustments. It was in her office in downtown with Bridgette Hubs’ (technician at Auditing) and we analyzed the documents. It was about the case when Wanda is accusing me in the “termination” about some procedures how those accounts were handled. Both of them (Verlaine and Bridgette) stated that the transaction was wrong.
I want to ask her why was she interested to find out so many things about my personal life?
I want to ask her why she insulted me, telling me that Romania is a country of gypsies and where the gypsies originated. That shows an uncultured person, or the intention of insulting.
Bridgette Hubs, Accounting Technician in Auditing, now working at AOC. I want her to explain that transaction we talked with Verlaine, and why she and Adriana Ramos her boss in Auditing didn’t respond to my email regarding Wanda’s error. I sent the email to Adriana and cc Bridgette. None of them responded to my email, why? If I were wrong, I am convinced I would have been in big, big trouble.
I want to mention that from the beginning when I was hired I worked with Bridgette and she appreciated me. Also, I appreciated her much. She is very intelligent, the most intelligent woman I worked with. Also she had integrity, she didn’t like cliques and I heard negative comments about her by the women in the clique.
Wanda Williams, manager in Accounting. I just want to ask her few questions only. First, I want to ask her (sure she’ll say she doesn’t remember), at the beginning when I worked with Bridgette Hubs, it was one afternoon and I was only Bridgette and I left in the office. Bridgette just left for few minutes and Wanda asked me “I hope when I’ll return, I’ll not find both of you under a desk”. I don’t think I could answer anything. I didn’t tell anybody so far. I don’t know what kind of impression had Wanda about me, but not a good one anyway, and I don’t know why.
To tell me if she remembers when she told me in her office in 2004, she asked me: “do you want just a job or want to be promoted?”
If she remember when she talked to Doloris about how she punished Kirk Lacefiled. It sounded like she was bragging about. Again, I couldn’t believe it, but I kept quite, I couldn’t foresee what will happen to me.
Wanda, why did you question me about my political views and religious convictions? Why did you want to know if Romania was close or far from Afghanistan? Did you think I was an Arab, a terrorist infiltrated?
Amy Callaway, coworker at CMJC. She was outraged of the so often lunches for up to two hours and three times a day of Wanda Williams and her clique (Sandy Mizuki, Monica Hodge and Lynn Dunbar). She gave me the list of the dates and time and the persons who and when went to lunch. It was an outrage in the whole department; Wanda divided the accounting in favorites, not favorites and enemies. Amy was honest and realized how Monica Hodge harassed everybody, including myself (she Amy’s email), until she was invited to lunch by Lynn Dunbar. Then, she changed totally and even accused me of harassment.
Amy Callaway accused Wanda of inspiring fear in the accounting when was a strike and only Kirk, Amy and I participated, the rest called sick or went to work.
I want to ask her if she has the dignity to say that she falsely accused me of harassment on that day when I closed with her.
Meredith Bostian, division manager CMJC. I want to ask her if she remember when I had a discussion with her and I told her about Wanda’s accounting error, same one in January 2004. Meredith told me: “when a boss tells you something, do not question anymore, drop it!”
It’s unbelievable in my opinion, to realize that big mistakes are made in accounting and not to say anything…because is a boss. That’s why it happen so many weird things at the court, because the managers they want to be immune to errors. Strange optics! So, if a manager makes a big mistake, should I have fear to bring it to superiors? Seems like I was hired in organized crime, there are no comments in front of the superiors, because they have their own laws, base on fear.
I want to ask her if she didn’t make an error signing the papers for suspending me for three and ten days, and if she has any regrets. She was aware of the crap brought in those papers to suspend me, but she had to defend Wanda Williams, another manager, no matter that it was clear to her that are there a lot of lies.
Linda George Dorraugh, coworker at CMJC. She was terminated in the last day when she supposed to be hired permanently. I am convinced the reason she was fired was because she told me that Doloris Gillam was spreading rumors about me. Doloris Gillam spread all kind of rumors about me. She stated that I was anti-American because I liked German beer, because I flue to Europe with KLM instead of AA or Delta, because I was driving a foreign care (a Mazda at that time). These are very strong accusations and I reported to Wanda Williams and to John Campbell at that time. We had a discussion and nothing else. Because Wanda asked me who told me, I was stupid and I told her that Linda. Now, I regret – Linda was fired due to Wanda’s revenge.
Doloris Gillam, coworker at CJMC. Doloris made few statements insulting me in 2001.
We were talking about medical insurance and I said: “I think it would be nice if everybody would have some kind of medical insurance”. Doloris’ attitude was rude and hysterical, she replied to me yelling: “you should go back where you came from, we don’t want communism here”!
I want to ask her why she changed the truth in her declaration. Who told her, pushed her to change the initial declaration? When I reported to Wanda Williams immediately, she admitted what she said, how she changed it later? She made false declaration of events when she complained about me. She lied! In the declaration against me she stated that we talked about sports and that I had an opinion about American justice, that’s a lie! But, she admitted insulting me.
I also want to ask her why did she spread rumors abut me that I was anti-American, what did I do to her? How could she bring such a serious accusations to somebody without any base?

Now, I’ll respond to the Court accusations and I’ll bring documents to substantiate my responses.
On January 29, 2007 – We had a Skelly meeting – Ted Somera, I and a Court manager.
At the meeting, Ted Somera, the UPE1 business agent brought a very good point: In July 19, 2004, Jody Patel, the ex-CEO of the Court (now CEO of AOC) stated very clear that progressive discipline should be taken by the Court. I was suspended for three days; the next punishment must have been for ten day and then termination. The Court didn’t even respected what the Court ex-CEO advised in writing, they wanted me out anyway, so, I was fired!
Special mention – The three days suspension, even the Court realized that it was too much and wanted to reduce the three days to one day. I refused, because Wanda Williams and Marcus Freeman brought a lot of false accusation and abused their functions to suspend me for three days. I refused to be part of their manipulation and I stated that ALL three days suspension must be rescinded
On January 2, 2007, I was sick and I called Wanda Williams at 6:56 A.M. and I left a message on her answering machine. I believed I called her on the cell phone. Suppose I didn’t call her cell phone, I have called and informed my manager that I’ll be late that day and it was no negative impact on Accounting or to any other department. At that day, Rork Crusto opened and were no problems at all. I remember different other cases when I came to work, not on my week to open, and I found quite a few times the Accounting door closed. Then it was impact, the clerks in Family Law and Probate could not get the cash bags. Every time it happened, I had to open as soon as I could myself and to mitigate the negative impact on other departments. I am convinced that nobody was punished for not coming in time or Wanda because did not listening the messages until much later. Other cases when the Accounting and the other departments were impacted when Account Clerks from CMJC came in the morning to do the process of opening. It was an impact because those clerks did not know exactly what to do, and delayed to distribution of cash bags. None of these examples were stated in the Termination Papers, and the whole issue was not complete. I do not have those emails, especially the one sent by Rick Beard to all of us at FRC in Accounting when nobody came to work that day. I didn’t think to keep that email. Anyway, I want to say that in few different cases I helped the Accounting unit with the opening process when others co-workers failed. I do not think that anybody can deny what I am stating now. An investigation in the emails could help what I am saying. Accounting never had a negative impact due to me. I consider that I had to be congratulated that many times I saved the accounting department from embarrassing by opening when somebody else didn’t show up for work and the supervisor and/or manager failed to take necessary action to make the opening on time. I guess, Wanda and Francine, and also Malay forgot so easy when I offer volunteer to come to open in the morning because Malay had a schedule issue and couldn’t make it, and in other occasions also. Good things are very easy forgotten. I think still should be the email when I volunteered for opening. Especial this accusation (in fact as all these allegations) made me outraged!
I want to state that it were few problems with the opening because Wanda Williams did not announce other employees to come early in the morning when somebody who had to open couldn’t do it. Yes, the Accounting and other departments were impacted due to Wanda’s lack of response to the problems arisen.
This incident as the rest of incidents has only the purpose to fire me, period. It’s so obvious!
On December 19, 2006, I was falsely accused twice of insubordination of my supervisor Francine Burrell. That day stared badly. At 8:41A.M. I wrote an email to my supervisor Francine Burrell that Malay Thongtip was making too much noise, talking too loud and laughing very loud, as she usually was doing. Not always I was in the mood to hear her laughing and definitely she was disturbing me. I had to work and I needed to focus on my job. Francine she is the same, she likes to talk loud and laugh loud too. Of course she stated that it was not loud and I was the one to blame, accusing me that they have to go on tip-toe because I had personal problems. I told them in past same thing in the past when they were out of control. It was true, I was very quite, my mother died on November 29, 2006. I told Francine about a month early that my mother was very sick, because I had to take some time off. I observed, since I told that my mother was very sick, they started to have much more fun and were much noisier. It was like a provocation, I can’t believe how low they had to go to provoke me.
At about 9:20 that morning I had an issue with Chitty Niru. She came for the bag and started to make jokes. I told her politely that I was not in the mood for jokes. She replied angry: “ok, from now on, don’t even talk to me!”
That morning I was also upset when I heard that Rork Crusto from Family Law got the position in Accounting. I knew him, and he told me that he had no experience in accounting and had an AA degree in Business. And again I was outraged that somebody without any experience and probably only one course in accounting was hired when, for sure, many others with more education and/or experience have been ignored. Again not the best candidate was hired; another race/favoritism issue. Why? I knew he made a service to Wanda, just when I applied for Accounting Supervisor, Rork Crusto complained to Wanda about me for a ridiculous reason; he didn’t like the way I answered a question. It was not the first time that I had some complaints just before I applied for better jobs.
Also that morning Veronica, the lead worker from Family Law approached me stating that she needed a report about reversals and voids. I told her that is for Francine to decide, and I told Francine what Veronica wants. Francine told me to do the report. I continued to process my deposits, because the deposits were priority, we had to send the monies with Loomis. Later, when I realized that Francine and Malay are working something together. I thought that they are working at the reversals/voids report, and I sent an email to Francine, asking her if she still needs my report. She never responded. Few days later, when we had a meeting with Rick Beard, Francine stated she never received that email from me.
That day started very, very bad. I was very, very stressed already. About one hour later that day I needed somebody to help me doing a reversal and I asked for help. Francine came to help me with the reversal, and I couldn’t understand why she came to help me because she couldn’t do it due to a problem with her password or OCS attributes. I was wandering if she forgot that she can’t do the process or she is looking to cause trouble. I remember that she asked me few questions regarding a transaction number which she thought it was a transaction of the bank, and I answered her that it was an OCS transaction. She was upset that couldn’t do the reversal. I told her that she had a problem accessing the OCS (and she knew that very well), and that problem was with MIS. She told me to come to see what the problem was, and when I heard her, I wanted to approach her then she suddenly raised and left, without giving me the chance to help her. Definitely she was there to set me up, started to yell at me so loud that I was twice insubordinate that day and I do not listen to her and that she’s a supervisor and I don’t lead the accounting. She created a circus environment yelling at me and abusing me with all kind of false accusations. Malay went and closed the Accounting door, and she continued to yell for few more minutes. Few minutes later, the supervisor from Family Law, Josh, knocked on the door and he asked where Francine was; he looked very concerned. I showed him Francine, she was at her desk. I was shocked and in disbelief! I knew that Francine wants to find reasons to fire me, I was sure. I never intended to disobey my supervisor and any superior, and I can say that I helped Francine as much as I could every time she asked for and not only.
Then I asked the help from the union, I had an exchange of emails and phone calls with Sandra Poole, and she asked the phone number of Francine to talk to her and to set up a meeting regarding the issues of that day. I never heard anything from anybody. A couple of days later we had a meeting with Rick Beard and Francine Burrell. I explained to Rick what happened and Francine lied when she stated she never received an email from me when I asked her if she needed my help with the reversals/voids report. Rick stated that Francine is a supervisor and she can ask me questions. I told him that I helped Francine every time she asked questions. I had the impression that it was an incident and everything was resolved. If I could access my work computer, I could prove that I helped Francine with any issue she had. But, I was blocked by the management even to go to Court. I have into my account many emails which can prove how false these accusations are.
In that day, I suffered a nervous breakdown.
On December 12, 2006 it was one of the most ridiculous accusations; in fact, all the accusations are just setups, pretexts to get rid of me, and nothing else.
On December 11, 2006, Wanda was asking me to participate to a meeting next day. Her email gave me the choice to accept or not to accept. I did not accept because I was convinced that the meeting on December 12 was about Malay. I even asked Wanda what kind of meeting will be next day, because if it was about Malay, I had the right to call UPE1, and I wanted Ted Somera to attend the meeting also. I realized that Wanda responded late that day, and I think I didn’t read that email on the December 11. I think I read it on December 13, when I came back to work. Anyway, that is irrelevant when I read the email or not, the point is that I could not come to work because I was sick. Wanda believed (it’s what she is claiming) that I did not want to attend the unit meeting. That’s absurd! I attended all or most of the meetings before, why that would have been different? That morning I was sick, I followed the instructions and I informed them that I could not come to work due to illness. Later that day, I got a phone call from Wanda stating to call her back and to bring doctor notice. I called the business agent Ted Somera from UPE1, and he told me that conform of the contract with the Court I am not required to bring a doctor’s notice. I didn’t bring a doctor notice. Even Ted Somera stated that it was confusion. To me, all these accusation are part of a plan, a conspiracy to set me up and to get rid of me. No normal person can do what Wanda Williams and Francine Burrell did to me. They interpreted everything I did or I said as hostile. As I stated in the past, Wanda was trying these tactics for long time, but the truth will prevail, I hope. In 2005, Wanda tried to make me to set up Arlene Benson. I couldn’t do it, it was not moral, and not ethic and of course, illegal; that’s a very low moral tactic; that shows to me her very low character. And, if she tried this procedure with me against Arlene, I am convinced she tried in different other occasions, probably against me or others.
It was in January 5, 2007 not January 3, as Rick Beard stated in the “Order of Termination”, when I made the statement regarding Rork Crusto’s skills. My statement was based on direct observation because I had to train him. When an employee is training another employee, usually an opinion is presented about how the training was, how good the trainee was doing, etc…. Why I was not supposed to say anything?
July 10, 2006 – I have no idea what could have been my “rude response to a coworker who asked if your mother prepared a dish”. I don’t know anything about they are trying to say here, it’s the first time I hear about.
July 18, 2006 – On that day, Verlaine McCaslin accused me of not reconciling a spreadsheet. I thought we could solve the problem between me and her, but at one point, she was ironical and cc her manager and my manager, despite the fact she was wrong. At that time, I got upset and I asked the help of out CEO, which he stated he’ll come to talk to me, but never came and nobody wanted to talk about that issue, who was wrong and who was right. I am convinced, if I were wrong; it would have been a big issue and it would have been in the “termination” papers as one of my big errors. Anyway, even in this case, I am the one to be blamed, that’s just ridiculous!
I had few more issues with Verlaine, one in which she asked me a lot of questions about my private life, and then she apologized. A different issue was that stated that gypsies are from Romania, in a way she considered me a gypsy, and I didn’t want to be associated with gypsies. In Romania and all over Europe, gypsies are considered in general bad people, who rob, steal, rape, murder, etc…. I think Verlaine wanted to insult me, to put me in a category with the low class people. I attach the emails regarding the reconciliation to prove that Verlaine was wrong.
Also, July 10, 2006 – That issue is much more complicated, not just “silently reading books” as is stated. It is a big issue about hypocrisy, which I considered with Malay. She tried to convert me to Jehovah’s Witnesses, to take me to Marysville to their conference, she brought tapes to work for me to take them home, she was preaching on the phone many times, etc…. Also Malay tried to bring me into a sexual case, and I filed a sexual harassment case against her. Even Johnny Smith admitted “some evidence” but never explained what evidence; he never wanted to meet with me and Ted Somera to discuss any problems at FRC. I told at that time to look at the camera, it could prove that I was right. Nobody cared about the truth!
Another case with Malay was when she proposed to me to be supervisor in accounting. That’s a different story, but very interesting to see how deep Malay was involved and how much she knew about behind the seen events.
Malay Thongtip was allowed to sell cosmetic products at the court; she stated that was with the approval of Johnny Smith. Wanda Williams and Francine Burrell were her clients, besides so many other employees. The court forbids selling of any kind of merchandise on the Court premises. Everybody (Wanda Williams, Francine Burrell, Johnny Smith didn’t care about rules and regulations of the court when is about a “high connected” employee.
